Terms of Use

These Terms of Use ("Terms") are an agreement between you and Bright Web Limited, a company registered in England and Wales ("we", "us"), covering your use of the Warm Turkey app ("the App"). By downloading or using the App you agree to these Terms. If you do not agree, please do not use the App.

Not medical advice

Warm Turkey is a self-tracking and motivation tool. It is not a medical device, does not provide medical advice, diagnosis or treatment, and is not a substitute for professional healthcare, addiction treatment or counselling. Figures shown in the App (money saved, calories avoided, time reclaimed and similar) are estimates based on the numbers you enter and on typical averages; they are illustrative, not guarantees.

If you are dependent on alcohol, stopping suddenly can be dangerous and in some cases life-threatening. Speak to a doctor or another medical professional before making sudden changes. If you are worried about your relationship with any substance or behaviour, please seek professional support — the App lists free services for your region under Settings → Get support.

If you are in crisis, contact your local emergency number (for example 911 in the United States and Canada, 999 in the United Kingdom and Ireland, or 000 in Australia) or a crisis line such as the 988 Suicide & Crisis Lifeline (call or text 988 in the United States and Canada) or the Samaritans (116 123 in the United Kingdom and Ireland). These numbers are examples and may change; the services listed in the App under Settings → Get support are matched to your device's region.

Your licence to use the App

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own personal, non-commercial purposes on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. Where the App is distributed through Apple's App Store, Apple's Licensed Application End User License Agreement (the "Standard EULA") also applies; where these Terms are stricter, these Terms apply.

Subscriptions and free trial

Some features require a paid subscription (weekly or annual). Payment is charged to your Apple ID account at confirmation of purchase, or at the end of any free trial period unless you cancel at least 24 hours before the trial ends. Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your App Store account settings. Amounts already charged are non-refundable except where required by law or by Apple's refund policies; refund requests are handled by Apple.

Prices are shown in the App before you purchase. We may change prices for future billing periods; you will be able to cancel before any change takes effect. The free trial reminder notification is a courtesy and depends on your notification settings; it is your responsibility to cancel in time if you do not wish to continue.

Your data and your responsibility

Everything you record in the App is stored locally on your device. We do not hold a copy, so we cannot recover data you delete, or data lost if your device is lost, reset or the App is uninstalled. The App offers a manual export you can use to make your own backups. You are responsible for the accuracy of what you log and for keeping any exported files safe.

Acceptable use

You agree not to misuse the App, including attempting to reverse engineer it except as permitted by law, using it to break the law, or reselling it. The App is intended for users aged 17 and over.

Disclaimers and limitation of liability

The App is provided "as is" and "as available". To the fullest extent permitted by law we exclude all implied warranties, and we are not liable for any indirect or consequential loss, loss of data, or loss arising from reliance on estimates shown in the App. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited under the law of England and Wales. Our total liability to you in connection with the App will not exceed the amount you paid us in the 12 months before the claim arose.

Nothing in these Terms affects your statutory rights as a consumer.

Changes and termination

We may update the App and these Terms from time to time; material changes will be shown in the App. If you keep using the App after a change takes effect, you accept the updated Terms. We may suspend or end support for the App with reasonable notice; your subscription rights through Apple are unaffected for periods you have already paid for.

Governing law and contact

These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction (if you live in Scotland or Northern Ireland you may also bring proceedings there).
